    Key Terms

    SmartFee

    ‘SmartFee’ refers to the relevant company that may provide fee funding.  SmartFee Pty Ltd ABN 70 168 943 486 (referred to as SmartFee Business on this website) only provides funding for business purposes.  SmartFee Personal Pty Ltd ABN 44 126 530 489 Australian Credit Licence 392210 (referred to as SmartFee Personal on this website) provides funding where the consumer credit laws apply.  

    Instalment Plan

    An arrangement for payments to be made by the Borrower to SmartFee by a number of equal payments.  SmartFee offers monthly instalment plans with terms from 3 to 12 months.

    Borrower

    A person or business that has agreed to pay their invoice for Professional Fees over monthly instalments through SmartFee

    Funding Agreement

    This is the agreement between SmartFee and the Professional Services Firm (Accountants/Lawyers) that provides for SmartFee to offer fee funding to clients of the firm. 

    Credit Reporting Agency

    An organisation whose business involves handling personal information in order to provide another entity with information about the credit worthiness of someone.

    Invoice

    A document that must state the services rendered by the Professional Services Firm, disclosing the amount due, payment terms and the entity to which it is issued to (in this case, the Borrower). The invoice must also be issued by the firm within the last 12 months.

    Direct Debit Request

    A contract signed by a Borrower and a Biller (or Merchant) allowing the Biller to debit the Borrower’s nominated bank account or card.

    Professional Fees

    Charges for the services rendered to someone (in SmartFee’s instance, a Borrower) from their Professional Services Firm. Typically these would be for accounting services or legal services.

    Director

    A person forming part of the senior management of a company who has the ability to influence key decisions of the company.  

    Professional Service Firms

    A professional services firm (such as an accounting or legal firm) that has an agreement in place with SmartFee to provide fee funding to their clients. These firms are appropriately licenced and accredited.

    Fee Funding

    Finance provided to persons or business for the purpose of paying an Invoice issued by a Professional Services Firm. The Professional Services Firm gets paid upfront (by SmartFee) for the total amount of the invoice and the Borrower pays the total amount owed on the invoice over a monthly schedule with interest charges.

    Tax Deductible

    Where the Invoice is for business purposes, you may be able to claim the borrowing charges as a tax deduction for your business.
